Beginning July 1, 2025, nonresident estates with Wyoming property up to $400,000 can skip a separate Wyoming probate. The estate must be probated in another state, file certified copies in Wyoming, and publish notice for three weeks. A Wyoming court can also order sale of in-state property within the $400,000 cap. This can cut duplicate costs and speed transfers.
Beginning July 1, 2025, more Wyoming estates can use quick probate shortcuts up to $400,000 after liens. You can present a simple affidavit 30 days after death to receive money or property held in Wyoming. You can also ask the court for a summary distribution order 30 days after death to transfer personal or real property. These options help many heirs avoid full probate and lower legal costs.
Beginning July 1, 2025, the United States, Wyoming, or local governments can collect a decedent’s assets by affidavit when the entire estate is $400,000 or less after liens. They must wait at least 90 days after death. This faster process can reduce what is left for heirs when government debts are owed.
Starting July 1, 2025, a written, irrevocable disclaimer that is not tax-qualified can still work under Wyoming law. The person who disclaims must state in writing that it is not a qualified disclaimer for tax purposes. This clears up estate planning and property transfers.
