Scholarship amounts and priority for families

Beginning with the 2025–2026 school year, education savings account (ESA) deposits are $6,000 a year for most students. Students in category a(i) get $7,000. Some students in category a(ii) get $7,000 if their household income is within the law’s federal‑poverty thresholds (up to 250% of FPL). Each year, 80% of awards go to category a(i) and 20% to category a(ii). If applications exceed funds, awards are first‑come, first‑served, with priority for last year’s recipients and for siblings of recipients.

Dedicated funding and account for scholarships

The state creates a Steamboat Legacy Scholarship program account to pay ESAs. It deposits $30 million from the general fund. The account can also take gifts and grants, keeps investment earnings, and carries over year‑end balances. County, city, and school district tax revenues cannot fund this program.

Quarterly payouts and admin withholding

ESA money is paid out four times a year. The state may keep up to 5% of deposits for administration in the first two school years and up to 3% after that. These withholdings reduce the money deposited into each student’s ESA.

Certified providers for ESA payments

The state certifies education service providers before they can receive ESA payments. Certified providers must meet minimum instruction standards for K–12 and prepare pre‑K students for kindergarten. Families get clearer, minimum standards for providers paid with ESA funds.

More education uses for ESA funds

Families can use ESA money for tuition and fees for summer education and specialized after‑school education programs. They can also use it for nongovernmental online learning programs. ESA funds cannot be used for after‑school childcare.

Court rules and legal protections

The state and public schools are not liable for ESA awards or their use. In provider court challenges, the state must prove the law is necessary and not an undue burden. Parents of eligible and ESA students may intervene in court to defend the law. The act also repeals specified 2024 provisions.

Parent curriculum and testing rules

If your student qualifies under category a(i), you must ensure instruction in reading, writing, math, civics (including the U.S. and Wyoming constitutions), history, literature, and science. The student must be tested for academic progress. You do not have to include instruction that conflicts with your or your student’s religious beliefs.

Misuse checks and loss of funds

The state investigates intentional, substantial misuse of ESA funds. If misuse is found, a student can be barred from getting ESA money, and if the account is closed for substantial misuse, any unused funds return to the program account. Parents and banned providers can appeal decisions. The state may refer suspected fraud to auditors or law enforcement.
