Clearer lease and maintenance rules for schools

Beginning July 1, 2025, leases for K-12 buildings must meet new maintenance rules. When a district or charter leases a building for the required educational program, the owner must keep it up to state standards. Leases of district-owned buildings must include payments that cover adequate maintenance to those standards. Each lease must list a separate major maintenance amount, keep it in separate accounts, use it only for major maintenance, and spend it only with district or charter approval. Districts and charters can ask the state construction department’s school facilities division to review whether the major maintenance amount is reasonable.

State cap on school lease reimbursements

Beginning July 1, 2025, the state reimburses lease costs when the leased square feet are not already counted for major maintenance. The payment equals the smaller of: the total lease amount, or a state-set average cost per square foot for comparable K-12 space times the allowed leased square feet. This ties reimbursement to both the lease bill and a square-foot cost benchmark.
