Stricter letters of credit rules for mines and waste

The law tightens who can issue letters of credit posted instead of a bond. For mines and solid waste facilities, letters must come from an FDIC-insured bank or an NCUA-insured credit union. Operators can still post federally insured CDs, cash, or U.S. government securities. Beginning July 1, 2025, the rule applies only to letters issued on or after that date. Existing letters issued before then remain under prior law.
