Any non-hospital clinic that does surgical abortions must be licensed as an ambulatory surgical center. Each clinic needs its own license, and licenses cannot be transferred. Clinics must follow all ambulatory surgical center rules. The Health Department’s rules are at least as strict and include a physical inspection every three years. Clinics cannot offer surgical abortions without this license.
Only physicians licensed in Wyoming may perform surgical abortions at facilities in the state. The doctor must have hospital admitting privileges at a hospital not more than 10 miles from the clinic. Each doctor who performs a surgical abortion must report each procedure to the Health Department, attest to good standing, and show those admitting privileges as often and in the form the Department requires.
Anyone who performs a surgical abortion without being a Wyoming-licensed physician commits a felony, punishable by 1 to 14 years in prison. A person who performs a surgical abortion without the required admitting privileges faces a $1,000 misdemeanor fine for each procedure. Violating facility licensure rules carries a misdemeanor fine up to $1,000 for each day the violation continues.
The law takes effect immediately under the Wyoming Constitution. The Health Department must issue all rules needed to carry out this law.
