Beginning July 1, 2025, a parent or guardian can sue a covered website that fails to do a reasonable age check. A winning parent gets $5,000 for each failure, plus damages, court costs, and reasonable attorney fees. Any person can sue if a site or verifier knowingly keeps ID information after granting access. Only private lawsuits enforce these rules, and you generally cannot waive this right.
Beginning July 1, 2025, websites that profit from material harmful to minors must check user ages and block minors. Acceptable proof includes a driver’s license or state ID, U.S. passport, military ID, tribal ID, other states’ IDs, or a credit/debit card that requires the owner be 18 or older. Platforms may also use other reliable and accurate methods. After granting access, the site or verifier cannot keep your identifying information.
Beginning July 1, 2025, the rules apply only if the minor is a permanent Wyoming resident, lived in Wyoming over one year, or was in Wyoming at least 31 straight days. The law does not cover internet service providers, general search engines, or cloud providers, and it does not apply where federal law protects platforms or where it would violate the U.S. Commerce Clause. Contracts made in violation are void and unenforceable. Contracts made before July 1, 2025, are not changed by this law.
