3 provisions identified: 0 benefits, 2 costs, 1 mixed.
At least 48 hours before getting abortion pills or a provider gives them, a pregnant woman must get an ultrasound. She may see the live image and view heart motion or hear a heartbeat if it is audible. The scan must meet normal local medical standards. The clinic must give her a paper with the date, place, ordering and performing providers, and confirmation of an intrauterine pregnancy with gestational age. Before dispensing the pills, the provider must verify the ultrasound happened. Breaking these rules is a misdemeanor: up to 6 months in jail, a fine up to $9,000, or both. The pregnant woman cannot be charged.
The law defines what counts as an abortion. It covers using drugs or devices to end a pregnancy knowing it will likely cause the unborn baby's death, including in multifetal cases. It does not include care to save the woman's life or health, remove a dead unborn baby, treat an ectopic pregnancy, or treat cancer or another disease. A chemical abortion means using medication to end a confirmed pregnancy. Pregnancy starts when a fertilized egg implants and lasts until birth.
If this article conflicts with the Life is a Human Right Act or W.S. 35-6-139, those laws control where they are enforceable. This can make rules stricter or looser depending on which law applies. The law takes effect immediately after all steps for a bill to become law under the Wyoming Constitution are complete.
