The law creates the enhanced oil recovery stimulus account. The State Treasurer invests it, and earnings stay in the account. The Governor can use it only to pay stimulus to CO2 suppliers. The account gets a one‑time $10 million transfer from the reserve. By September 1 each year starting in 2025, the State Auditor tops the account up to $10 million from the general fund, then sends any leftover to the reserve (up to $10 million total under this rule). If no money is spent before July 1, 2034, all funds in the account revert to the reserve on that date.
Beginning July 1, 2025, CO2 suppliers can get $10 per ton for CO2 used and stored in Wyoming oil recovery. The CO2 must be captured in Wyoming and used in a Wyoming enhanced oil recovery project. The supplier must already qualify for and receive the federal 45Q tax credit. The state adjusts the payment when 45Q amounts change, and no payment is available unless the geological storage credit is more than $15 above the oil‑recovery credit. Payments come only from the stimulus account and are prorated if the account is short.
The Wyoming Energy Authority runs the program and verifies eligibility before any payment. It sets rules, reports eligible cases to the Governor and State Auditor, and the Auditor pays providers. By November 1 each year, the authority reports amounts paid and revenue effects to two interim legislative committees. By August 1 each year, the Department of Revenue reports severance taxes tied to oil and gas made with captured CO2, and the authority reports stimulus amounts to state officials.
