Beginning July 1, 2025, an insurer that misses renewal must meet all original certificate requirements before getting a new one. Insurers and licensees must report changes to address, phone or email within 30 days. When the commissioner is served with legal papers, the commissioner must promptly mail a copy by certified mail to the insurer’s designated recipient. Producers must report out‑of‑state administrative actions within 30 days of final disposition, and any criminal prosecution within 30 days of the first pretrial hearing, with required documents.
Beginning July 1, 2025, insurers seeking an original certificate must meet required capital and surplus levels. Applications must be under oath by top officers and include the insurer’s name, office location, lines of business, organization details, domicile, fees and any other information the commissioner requires. The commissioner may require a modified name if there is a name conflict, and may examine applicants before issuing and recording the certificate as legal proof. For proposed domestic mutual insurers, incorporators must post a $15,000 bond before soliciting applications. If a proposed domestic insurer does not organize and secure its certificate within one year of incorporation, its powers cease and advance deposits or premiums held in trust are returned.
Beginning July 1, 2025, the law clarifies what counts as an insurance transaction for personal, family or household coverage, focusing on eligibility and servicing. The property and casualty article applies to all P&C defined in state law, but not to binders or other temporary contracts, and not to personal auto policies.
Beginning July 1, 2025, several subsections of the insurance code are repealed. Some prior obligations in those sections no longer apply.
