If your land touches state land and you do not lease it, you can build a lawful partition fence. If the state land is leased, the lessee must pay 50% of the actual construction cost. If it is not leased, the Office of State Lands and Investments pays 50%. You and the state office or the lessee share fence maintenance based on your respective interests. The fencing and cost-sharing rules start July 1, 2025. The Board of Land Commissioners must issue rules to carry this out, and that rulemaking authority is effective immediately.
