COVID-19 EIDL Fraud Statute of Limitations Act of 2022

Sponsored By: Representative Luetkemeyer, Blaine [R-MO-3]

Became Law

Summary

Extends the time to file fraud charges or civil enforcement actions tied to COVID-19 EIDL loans and advances to 10 years. This law applies that 10-year filing deadline to three categories: SBA Section 7(b) EIDL loans as defined by the CARES Act, EIDL advances under CARES section 1110(e), and Targeted EIDL advances under section 331. It does not add funding or change who can get loans. The only change is a longer window for criminal or civil fraud actions related to those pandemic-era EIDL programs.

10-year fraud window for COVID disaster aid

The law gives the government 10 years to file fraud charges or civil cases tied to COVID-19 EIDL aid. It covers EIDL loans made for COVID-19, EIDL advances under the CARES Act, and Targeted EIDL advances. The 10-year clock starts when the offense happened. This does not change who can get help or how much you owe; it only extends the filing window. The rule is in effect now.
