Became Law

Summary

The law ties each transfer to financial, safety, and management conditions and preserves key federal rights and flood protections.

  • Counties: Counties must pay a third‑party appraised fair market value and cover survey and transfer costs in advance. They must show they can operate and maintain the land and meet State fire, safety, and health codes within two years after conveyance and complete title agreements within three years.
  • Local users and permit holders: Existing permits and improvements by permit holders are excluded from the appraisal value. The land must be managed for public access, recreation, fish and wildlife habitat, or preservation, and the law allows existing docks, boathouses, ramps, and vehicle access easements to continue.
  • Federal interests and liability: The transfer preserves reserved oil, gas, and mineral rights, flowage easements, and certain management agreements. The United States limits liability for flood damage and requires counties and future recipients to indemnify the United States for specified claims and projects.

Sets parcels for Nebraska reservoir transfers

The law sets the maps, parcel sizes, and parties for land transfers at Hugh Butler and Swanson Reservoirs in Nebraska. It names five parcels: Lakeview Lodge Concession (about 21.5 acres; map August 2023); Red Willow Cabin (about 6.5 acres; map March 2024); Red Willow Concession (about 23 acres; map August 2023); Swanson Cabin (about 6.2 acres; map March 2024); and Swanson Concession (about 20 acres; map August 2023). It names Frontier County, Hitchcock County, the State of Nebraska, and the Secretary of the Interior as parties. It defines fair market value and what a title transfer agreement is. This clarity lets counties and operators move forward with title transfers.
