Introduced

Summary

Gives the President power to temporarily suspend the federal gas tax during a national emergency. The bill would let the President set the federal base gasoline and diesel tax to zero for a 60-day window that can be extended once to 120 days and requires Treasury to transfer money from the general fund to replace lost receipts for the Highway Trust Fund and the Leaking Underground Storage Tank Trust Fund.

Show full summary
  • Drivers and households: Would pay no federal base gas tax on fuel sold during a declared suspension, lowering pump taxes for 60 to 120 days.
  • Highway and LUST trust funds: Treasury must transfer amounts from the general fund to make up for the credits the suspension removes so those funds keep receiving their prior levels of receipts.
  • Presidential limits and timing: The President must find a substantial disruption in supply or a substantial price increase to trigger the pause, only one suspension is allowed per emergency, and the authority ends for fuel sold after December 31, 2028.

*Would shift the cost of lost gas-tax receipts onto the federal general fund by requiring transfers to the Highway Trust Fund and the Leaking Underground Storage Tank Trust Fund.*

Temporary gas tax pause for drivers

If enacted, this bill would set the federal tax rate on taxable gasoline and diesel to zero during a declared national-emergency suspension period. The Leaking Underground Storage Tank (LUST) financing rate would also not apply to covered fuel. The President would declare a 60-day suspension starting on the date specified. The President could extend it to 120 days if he notifies Congress in writing at least 15 days before day 60. Only one suspension could apply per national emergency. The Treasury Secretary would transfer money from the general fund to make the Highway Trust Fund whole for lost tax credits. The Secretary would also replace LUST Fund receipts lost during the suspension. The suspension would apply to fuel removed, entered, or sold after enactment. It would not apply to fuel removed, entered, or sold after December 31, 2028. Households could see lower pump prices, but the bill would not guarantee the tax cut is passed to buyers.
