Combating Illicit Xylazine Act

This bill would place xylazine on Schedule III of the Controlled Substances Act to curb illicit use and trafficking. It would also redefine who may possess xylazine legally, add the drug to federal tracking systems, and require sentencing guidance and periodic reports to Congress.

  • Veterinarians and animal owners: The bill limits who counts as an "ultimate user" to people who receive xylazine from a veterinarian or a registered pharmacy. Possession is restricted to animals they own or care for and to government or wildlife program uses.
  • Manufacturers and practitioners: Entities manufacturing xylazine at enactment would not have to install new capital security standards. Labeling rules are delayed for 1 year and practitioner registration, inventory, and recordkeeping requirements are delayed for 60 days to allow a transition.
  • Law enforcement and courts: Federal ARCOS tracking would be expanded to include xylazine. The U.S. Sentencing Commission must review penalties and the Attorney General, DEA, and FDA must report to Congress at 18 months and again at 4 years on prevalence, trafficking, and related risks.

Transition relief for xylazine makers and vets

If enacted, xylazine businesses would get transition relief. Existing makers would not have to install new Schedule III security systems. Labeling and shipping rules would start 1 year after enactment. Practitioner registration and record rules would start 60 days after enactment, and applicants could keep working while applications are pending. FDA and DEA would speed related paperwork for manufacturers.

Stronger federal controls on xylazine

If enacted, the government would treat xylazine as a Schedule III drug. DEA would add it to its national drug reporting system. Makers, distributors, and pharmacies would have to report xylazine shipments. The Sentencing Commission would review penalties for xylazine crimes. The bill would also define xylazine to include its salts and isomers.

Who can hold xylazine for animals

If enacted, a person who gets xylazine from a registered vet or pharmacy for an animal they own or care for would be the “ultimate user.” You would not need to register to possess that xylazine. This would also cover government animal‑control and wildlife programs, and businesses where animals are kept.
