Romance Scam Prevention Act

• Members: If you received messages from a banned account you get a clear notice with the banned user’s handle, the most recent message time, a fraud warning, safety tips, and provider contact. Notices must be sent within 24 hours, though providers may delay up to 3 days in limited cases or at a law enforcement request.
• Providers: Dating platforms must implement clear, conspicuous notification systems and may send alerts by email, text, or other agreed means. The law offers a safe harbor from liability for actions taken to comply.
• Enforcement and states: The Federal Trade Commission enforces the rule under its consumer-protection authority. States can sue on behalf of residents in federal court but must notify the FTC, allow it to intervene, and cannot bring parallel enforcement while a federal action is pending. The law also creates a national standard that prevents states from requiring or banning these notifications while preserving state contract and tort laws.

The law takes effect one year after enactment.
