Reentry Act of 2025

Sponsored By: Representative Tonko, Paul [D-NY-20]

Introduced

Summary

Medicaid coverage for the 30 days before release. This bill would let states provide Medicaid to people in public correctional facilities during the 30 days immediately before their release. It would also require the Medicaid and CHIP Payment and Access Commission to report to Congress within 18 months on the inmate exclusion and the bill's effects.

Show full summary
  • People nearing release: Would be able to enroll in Medicaid during the 30-day pre-release window, which could help link them to medical care and addiction treatment after release.
  • States and Medicaid agencies: Could add this coverage through a State plan or a waiver. MACPAC must estimate how many incarcerated people would be eligible and the preliminary impact on coverage and transitions.
  • Correctional facilities and health providers: MACPAC must analyze care in correctional settings, health and safety standards, applicability of Medicare/Medicaid conditions of participation, licensing and accreditation, and current discharge and enrollment practices.
  • Congress and policymakers: The report must include recommendations for actions by Congress, HHS, or states to improve access to comprehensive coverage and help transitions to community services and treatment.

Medicaid help before jail or prison release

States could choose to give Medicaid coverage during the 30 days before someone leaves a public jail or prison. You would still need to meet Medicaid eligibility rules. This could help start care, refill meds, or set up treatment before release. If enacted, this would take effect upon enactment.
