Sponsored By: Representative DeGette, Diana [D-CO-1]

Introduced

Summary

This bill would grant permanent resident status to Jeanette Vizguerra‑Ramirez by making her eligible for an immigrant visa or for adjustment to lawful permanent resident despite certain numerical limits in the Immigration and Nationality Act. If she entered the United States before the filing deadline she would be treated as having entered and remained lawfully and could adjust status as of enactment, provided she files the required application and pays fees within two years. If she receives an immigrant visa or permanent residence, the Secretary of State would reduce by one the number of immigrant visas available to natives of her birth country in the current or next fiscal year. Her natural parents, brothers, and sisters would not acquire any immigration rights from this action.

Green card relief for Jeanette Vizguerra-Ramirez

If enacted, Jeanette Vizguerra-Ramirez would be eligible for an immigrant visa or to adjust to a green card. Normal visa caps would not block her case. She would need to file an immigrant visa or adjustment application, with fees, within 2 years after enactment. If she is in the United States before that 2-year deadline, she would be treated as having entered and stayed lawfully as of enactment, and could adjust if otherwise eligible.

One visa cut and no family benefits

If she is granted a visa or green card, the State Department would cut by one the visas for people from her country of birth in that year or the next. Her natural parents, brothers, and sisters would not get any immigration rights from her case.
