Stops federally qualified health centers from being charged more than the 340B ceiling price at the time of purchase and forbids later reconciliations that raise upfront costs. It would bar deals that require higher payments at purchase and then use rebates, reimbursements, or other payments after the sale to make up the difference.

  • Federally qualified health centers: Would not have to pay more than the 340B ceiling price when buying covered outpatient drugs. Post‑purchase reconciliations by rebate or reimbursement could not be used to justify higher upfront charges.
  • Drug manufacturers: Could not enter agreements that force covered entities to pay above the 340B ceiling price at purchase or that rely on later reconciliation to offset an upfront overcharge.
  • Agreement reviews and timing: The changes would apply to drugs purchased on or after enactment. The Secretary would take these amendments into account when determining whether a manufacturer agreement meets 340B requirements.
