  • Operators would need to include information like that listed in 43 CFR 3809.301 and provide financial assurance the Secretary finds adequate.
  • The Secretary of the Interior or the Secretary of Agriculture for National Forest System lands would review notices and must tell operators within 15 days if required criteria or information are missing.
  • The bill defines key terms such as exploration activity, operator, public land, and casual use so the limited-surface-disturbance pathway applies clearly to eligible lands and activities.

New notice rules for mineral exploration operators

If enacted, mineral exploration operators would have to give notice to the Interior or Agriculture Secretary at least 15 days before starting any exploration that will disturb 25 acres or less of public land. The notice would need the information the Secretary requires, which may include items in 43 C.F.R. §3809.301. Operators would also have to provide financial assurance the Secretary finds adequate. The Secretary would have 15 days to allow the activity or to tell the operator what information or assurances are missing. This would not cover activities that remove material for commercial sale.
