SOS: Sustaining Outpatient Services Act
Sponsored By: Representative Smith, Adrian [R-NE-3]
Introduced
Summary
Treats low-volume off-campus outpatient services as hospital outpatient payments starting in 2027. This bill would add a rule that any item or service furnished at an off-campus outpatient department would be paid under the hospital outpatient prospective payment system for a year if, in the prior year, the greatest total paid under the physician fee schedule to physicians in that specialty for those items was under $2,000,000.

Medicare outpatient payment changes
If enacted, this bill would start in 2027 and move some outpatient items and services given at off-campus hospital outpatient departments into the hospital outpatient prospective payment system (OPPS). This would apply when, in the previous year, the physician specialty that furnishes that service had less than $2,000,000 paid under the physician fee schedule. The payment change would alter who bills the service and could change your Medicare cost-sharing and provider payments. Effects would vary by service and are likely limited to a subset of outpatient services.
