New Medicare Part B rebate rules
This bill would change how Medicare Part B drug rebates are calculated. It would count drugs that would be payable under Part B, including commercial-market sales. It would replace old unit counts with a billing-unit method using NDC reports and subtract units paid by State Medicaid. It would move the rebate baseline dates back to 2015–2016. These rules would apply to calendar quarters starting on or after January 1, 2026.
Changes to Medicare Part D unit counts
This bill would change how Medicare Part D counts drug units for AMP and rebates. It would use manufacturer and State reports to define total units. It would exclude units paid by State Medicaid and units with Part B rebates, and it would exclude 340B-discounted units beginning in plan year 2026. It would move baseline dates back to 2016. These rules would apply to applicable periods starting on or after October 1, 2025.
