Show full summary
- Workers who publicly or privately say, write, or display that sex is binary or biological would be shielded from hiring, firing, suspension, or other workplace penalties for that expression.
- Employees who request or use a single-sex bathroom, changing area, or any space where physical privacy is important would be protected from adverse employer action for doing so.
- Employers could not defend such actions by saying they were job related or a business necessity. The bill would add explicit anti-retaliation protection for these new rights.

Worker protections for sex expression

Covered expression would include speech, writing, depictions, wearing or owning items with such messages, and the use of pronouns. It would also bar adverse actions for requesting or using single-sex bathrooms, changing rooms, and other private spaces. Employers could not use a job-relatedness or business-necessity defense for these practices. If enacted, the bill would make retaliation unlawful for activity protected by this new rule.
