Summary
Elevates agricultural national security. This bill would require the Committee on Foreign Investment in the United States to decide whether agricultural land transactions flagged by USDA need a national security review and would add the Secretary of Agriculture to CFIUS for agriculture-related transactions.
Show full summary
- Farmers and rural communities could face federal review of land sales when USDA suspects a covered transaction and the buyer is from one of four listed countries: China, North Korea, Russia, or Iran.
- Foreign persons of those four countries who must report purchases under the Agricultural Foreign Investment Disclosure Act would see their acquisitions of agricultural land subject to targeted CFIUS consideration and possible action.
- The Secretary of Agriculture would be a CFIUS member for deals involving agricultural land, agricultural biotechnology, or the agriculture industry. CFIUS would have to decide if a USDA-referred transaction is covered and whether to open a national security review. The requirement sunsets for a country if it is removed from the federal foreign adversary list.

New review for foreign farm land purchases
This bill would add the Secretary of Agriculture as a member of the U.S. foreign investment review committee for deals involving farm land, farm biotechnology, or farm transportation, storage, and processing. If the Secretary notifies the committee about a reportable agricultural land transaction by a foreign person from China, North Korea, Russia, or Iran (and the deal must be reportable under AFIDA section 2(a)), the committee would have to decide whether the deal is a covered transaction and whether to start a formal review. The notice-triggered review authority would stop for a country when that country is removed from the foreign adversaries list in 15 CFR 791.4. If enacted, this could increase agricultural expertise in national-security reviews and could slow or block some foreign purchases of U.S. farm land from those listed countries.
