- Patient advocacy organizations would have their names and payment amounts reported, including payments routed indirectly through third parties. This applies to groups that qualify under Internal Revenue Code 501(c)(3) and that focus on patient education, advocacy for diagnosed conditions, or support for vulnerable patients and families.
- Applicable manufacturers and group purchasing organizations would face a new annual electronic reporting duty that covers any direct or indirect transfer of value and expands the list of covered recipients to include patient advocacy organizations. New reports on patient advocacy payments
This bill would require drug and device makers and group purchasing organizations to report payments to patient advocacy nonprofits. Reports would be filed electronically to the Secretary. The first report would be due March 31, 2027, and after that reports would be due on the 90th day of each calendar year. Reports would include at least the advocacy group's name and the payment amount. The bill would expand "covered payment" to include any payment or transfer of value, including indirect payments passed through third parties when the company caused the third party to give money to the nonprofit. The bill would define "patient advocacy organization" as a tax-exempt 501(c)(3) that meets at least one test: gives patient education/support, is focused on a diagnosable medical condition, or has a mission to help vulnerable people with medical conditions. The bill would also state that the Paperwork Reduction Act does not apply to these reporting rules.
