CMS study on drug ingredient supply
This bill would require the CMS Administrator to send Congress a report within one year. The report would analyze how CMS coverage and payment rules could protect U.S. and allied markets for active pharmaceutical ingredients and key starting materials and reduce dependence on foreign adversaries under 15 CFR 791.4. It would be allowed to recommend price-floor commitments to support domestic API manufacturing and to prioritize domestically made ingredients when a U.S. source exists. The report would also identify gaps in data about the origin and ownership of APIs and key starting materials that CMS would need to implement any recommendations.
