Toyo Kohan Found Not Dumping

Commerce found that Toyo Kohan Co., Ltd. had a weighted-average dumping margin of 0.00% for the period May 1, 2023 through April 30, 2024. Because of this finding, entries of Toyo Kohan’s subject merchandise from that period will be liquidated without regard to antidumping duties.

Automatic 45.42% Assessment Risk for Some Intermediated Entries

Commerce will apply its automatic assessment practice for entries produced by Toyo Kohan that were sold to an intermediary when Toyo Kohan did not know the merchandise was destined for the United States. In those cases, Commerce will instruct U.S. Customs and Border Protection to liquidate unreviewed entries at the all-others rate of 45.42% if there is no rate for the intermediate company.

Importers Must Certify Duty Reimbursement

Importers must file a certificate about reimbursement of antidumping duties prior to liquidation of relevant entries during this review period. If importers fail to file the certificate, Commerce may presume reimbursement occurred and assess doubled antidumping duties.

Cash Deposit Rules Set After Publication

For shipments entered or withdrawn for consumption on or after the publication date, the cash deposit rate for Toyo Kohan will be zero percent. Previously investigated or reviewed companies will keep their most recently published company-specific cash deposit rates, and the cash deposit rate for all other producers or exporters will remain 45.42%.
