Most employers must post pay ranges

Most Delaware employers must list the pay (hourly or salary) or a pay range and a short description of benefits in every job posting. How wide the range is counts when judging good faith. Employers must tell all employees about each opening; temporary, interim, or acting jobs that need an immediate hire are exempt, and the Department may set rules for those roles. If no posting is available to an applicant, the employer must share the pay or range and benefits before any offer and anytime on request. Commission jobs must say they are commission-based and may omit a range. Tipped jobs must say they are tipped and list the base wage or base wage range. Employers must keep job descriptions and each worker’s pay history while employed and for three years after, and show them to the Department on request. Employers with 10 or fewer employees are not covered. These rules take effect one year after enactment.

Penalties and protections for pay transparency

The Delaware Department of Labor enforces these pay transparency rules and can investigate violations. A first offense gets a written warning. Each later offense brings a civil penalty of $2,000 to $10,000 per job opening; one opening counts as one violation no matter how many postings. Retaliation against someone who complains, helps the Department, or testifies triggers a $2,000 to $10,000 penalty per act. The Department issues final written orders; you can appeal to Superior Court within 30 days, and the Department can ask the court to enforce unpaid orders. Third‑party sites or services that repost job notices are not liable under this law. These enforcement rules apply one year after enactment.
