No license or insurance for low speed scooters

If you ride a qualifying low speed scooter, you do not need a driver’s license, registration, title, license plates, or vehicle insurance for that scooter. This removes paperwork and lowers ownership costs.

Helmets required for riders under 18

All operators and passengers under 18 must wear an approved, properly fitted, and fastened bicycle helmet when riding a low speed scooter. “Approved helmet” and any exceptions follow Delaware § 4198K.

Fines for unlawful motorized scooter use

For motorized devices still covered by the statewide ban (not low speed scooters), unlawful operation brings fines. A first offense is $25 to $115. A second or later offense within 24 months is $57.50 to $230. A court may also order the device forfeited.

No speed changes without new label

You may not change a low speed scooter’s motor or speed settings to alter its powered speed or engagement unless you replace its classification label after the change. This keeps the scooter’s class and speed clear for riders and police.

Safety labels and standards for scooters

Beginning January 1, 2026, makers and distributors must put a permanent label on each low speed scooter. The label must show the class number, top assisted speed, and motor power, in Arial, at least 9‑point type. These scooters must also meet U.S. Consumer Product Safety Commission rules for electrically powered toys and articles (16 C.F.R. Part 1505).

No rental services for low speed scooters

Businesses may not operate rental services that use low speed motorized scooters in Delaware. Customers cannot rent these scooters from companies in the state.

Where low speed scooters can ride

A low speed motorized scooter is one that cannot go over 19 mph. These scooters have the same rights and duties as bicycles. You can ride them where bikes can go, like streets, bike lanes, and multi‑use paths. You may not ride them on sidewalks. Local or state agencies may ban them on a specific path after notice and a public hearing, and they may ban them on nonmotorized, natural‑surface trails. The statewide ban on motorized scooters does not apply to these low‑speed scooters.
