Military child care exempt from state license

The law creates a "military family child care provider" category. It means a family child care home that serves only dependent children eligible for Department of Defense (DoD) subsidized care, and is on a base or federal property, or is certified by DoD or the U.S. Coast Guard. These providers are exempt from Delaware’s child-care licensing. DoD or the Coast Guard, or their agents like an installation commander, decide which children these exempt providers may serve. These changes take effect 60 days after enactment.

Which homes and programs need a child-care license

When a state-owned entity runs an early education program, only the program itself must be licensed and meet OCCL rules. A maternity ward of a general hospital is not covered by this child-care licensing section. An individual foster or adoptive home is also excluded when a state-licensed child placing agency placed the children. These changes take effect 60 days after enactment.
