Definitions for AI and Generative AI

The law defines "Artificial Intelligence" as a machine-based system that makes predictions, recommendations, or decisions toward set goals. It also defines "Generative AI" as models that create synthetic content like text, images, audio, or video. These definitions guide the Delaware AI Commission and state work on AI. They stay in effect until July 17, 2034.

New makeup of Delaware AI Commission

The Delaware AI Commission now has 23 voting members. Twelve serve by office; 4 are appointed by the Senate leader, 4 by the House leader, and 3 by the Governor. Appointed members must live in Delaware. Several seats are reserved for AI experts in higher education, private-sector leaders with AI experience, a lawyer with constitutional-rights expertise, and legislators from both parties. Appointed voting members serve up to 3 years and may be reappointed. A seat can be declared vacant if a member misses three meetings in a row without just cause. Members serve without pay, but mileage and tolls can be reimbursed. Each year, the Chair adds one nonvoting high school student in grades 10–12, with preference for students interested in AI. These rules stay in effect until July 17, 2034.
