Police barred from immigration enforcement and data sharing

Delaware law-enforcement agencies cannot enter or renew deals to do federal immigration enforcement. They cannot detain or house people for federal civil immigration violations. They may share nationality, citizenship, or immigration status only with a valid judicial warrant or when federal law requires it. Any existing immigration-enforcement agreement must be ended by using its termination clause by July 1, 2025. The law still allows work with federal partners on non-immigration public safety.

Which agencies must follow these limits

The law lists which Delaware agencies count as law-enforcement under this chapter. It includes state, county, city, and university police; DNREC; Capitol Police; probation and parole; the State Fire Marshal; the Department of Justice; and alcohol and tobacco enforcement. Agencies on this list must follow the immigration-enforcement bans and the July 1, 2025 termination deadline.
