Payout rules if the fund ends

If the Trust Fund ends, its money is paid out. Half goes to tenants who lived on rented lots for at least the 12 months before the shutdown, split evenly among those tenants. The other half goes to landlords based on how many lots they had rented for at least those 12 months. Your share depends on the total money in the Fund and the number of eligible tenants or lots.

Trust Fund capped at $15 million

The law caps the Delaware Manufactured Home Relocation Trust Fund at $15,000,000. The Board can raise, lower, remove, or bring back this cap if it meets its voting rules. The cap limits how much money the Fund can hold for relocations.

Trust Fund law ends July 1, 2029

On July 1, 2029, the law that governs the Trust Fund expires. After that date, the Trust Fund’s rules stop working. Future assessments or payments under this law end after July 1, 2029.

Monthly lot fee split for tenants and landlords

The Board sets a monthly fee for each rented lot in a manufactured home community. The fee can change or stop, and the Board must notify landlords and tenants. Tenants pay half and landlords pay half. Landlords get a $1.50 credit each month for each rented lot. $1.50 of the tenant share goes to the Manufactured Home Owner Attorney Fund.
