Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 1 costs, 1 mixed.

School tax payment plan after reassessment

In the first year after a general reassessment, you can use a school-tax payment plan if you qualify. Your home must be your primary residence and zoned residential, and your bill must rise by $300 or more from last year. The plan lets you pay in at least three equal parts with no interest, penalties, or late fees when paid on time. Counties may add extra rules, but they cannot be unduly restrictive or burdensome. If you enter and follow the plan that year, the county waives late-payment penalties on your school taxes. In New Castle County, if you are on a lawful payment plan, the county does not have to send the usual December demand letter.

Late fees for school taxes by county

The law sets county late fees on school property taxes. In New Castle County, unpaid school taxes after September 1 get a 5% penalty. The county then adds 1% more each month until you pay. In Kent and Sussex Counties, the penalty is 1% per month after September 30 until paid.

Property tax changes end after three years

This law ends three years after it became law unless extended. When it ends, the payment plans, penalty waivers, and late-fee rules in this law no longer apply.
