Fines on colleges for record violations

The State Auditor can fine a school for a knowing violation of these record rules, after a case decision under state law. The first knowing violation is a $10,000 penalty. A second or later knowing violation within five years of the first is $50,000 per violation. When a penalty is imposed, the Auditor must report the violation and amount to the Public Integrity Commission, the Department of Justice, and the Office of the Controller General.

Colleges must keep pay records five years

The law defines which colleges are covered. It covers public or private schools in Delaware that grant degrees and get State money. Covered schools must keep the pay and compensation records that state law requires. They must keep these records for five years.

State Auditor can get college pay records

When the Delaware State Auditor asks, a covered school must provide these records. This applies to the University of Delaware and Delaware State University. It covers any employee paid in whole or in part with State funds. The records support oversight of state-funded pay.
