State-run pre-K must be licensed

The law requires early education programs run by the state or local school systems to be licensed and monitored by the Office of Child Care Licensing (OCCL). These programs serve children younger than kindergarten. They must meet OCCL health, safety, and child development rules. This sets clear oversight for public pre-K programs.

Who counts as child care provider

The law defines who counts as child care. A provider cares for one or more children under 18, is paid, and holds itself out as providing child care. It includes family child care homes, large family homes, centers (including school-run pre-K), child placing agencies, residential facilities, day treatment, and part-day or full-day programs. It excludes foster or adoptive homes when a State-licensed agency placed the child. Maternity wards of general hospitals are not covered by this licensing section.
