Stronger subpoena powers for Delaware Auditor

The Delaware Auditor of Accounts can issue subpoenas directly across the state. The Auditor can require testimony under oath and demand books, papers, and records. Subpoenas may be served by the Auditor’s staff or any sheriff, by personal service, leaving it at a home with a suitable person, or by certified mail. For businesses, service may be on the registered agent or another authorized person, in person or by certified mail. If a properly served person does not respond, the Auditor can ask the Superior Court to order them to appear, and the court may punish disobedience as contempt.
