Sussex Vo-Tech school tax set locally

The law removes the state-set cap on the Sussex County Vocational-Technical High School District’s property tax for current expenses. The elected district board now sets this school tax rate. Your property’s district tax line can change based on the board’s decision each year. The old caps (26.50¢ for 2021, 27.50¢ for 2022, 28.50¢ for 2023, and 29.50¢ for 2024 and later) no longer limit the rate.

Sussex Vo-Tech admissions and capacity rules

The law ends fixed seat caps. The Delaware Department of Education now sets enrollment capacity through a Certificate of Need process. If more students apply than seats, the district runs a random lottery and admits in order until full. No one sending district can exceed its share based on its part of the county’s eighth‑grade class. Only two preferences are allowed: siblings of current students, and children of district employees who work 30+ hours per week. The school cannot block the lottery for a GPA below the 70th percentile or a failed eighth‑grade course if the student is still eligible for promotion under state standards. Except for expulsions under §4130, the school cannot remove a student for discipline without the parent’s and the home district’s consent.
