Task force to ease small restaurant rules

The law creates the Small Restaurant Regulatory Reform Task Force. It reviews rules from the Department of Health and Social Services that affect small restaurants and other sites with kitchens. It must identify unnecessary burdens and propose concrete steps to cut them while keeping health, safety, and the environment protected. It also evaluates whether state funding is needed to carry out its recommendations. Every state agency must promptly share information the Task Force requests. The co-chairs must submit a final report by June 1, 2026, to the General Assembly, the Governor, and Legislative Services.

Who's on the restaurant task force

The Task Force has 15 members. Two are House members and two are Senate members, split between majority and minority leaders’ picks. Seven serve by position, including the Governor and key agency heads. These are Health and Social Services, Public Health, State Fire Marshal, Small Business, Restaurant Association, and Alcoholic Beverage Control. County leaders appoint one representative for New Castle, Kent, and Sussex counties. The Governor also appoints an owner of an early care and school-age center with a kitchen on-site. Members serving by position may send a written designee. Members choose two co-chairs at the first meeting. A majority of members makes a quorum, and official actions need approval by that quorum. The Task Force may adopt rules; if not, Mason’s Manual governs. Co-chairs manage notices and records, and file the final report with the General Assembly, Governor, Legislative Services, and Public Archives.
