Delaware renters can clear evictions

You can ask the court to vacate your eviction judgment and expunge the case. The court must grant it if any apply: five or more years since a judgment on the merits or default and you paid any money owed; the judgment was by agreement and you followed it and paid; the landlord withdrew the case; the court dismissed the case; you won; both sides agree; or expungement is clearly in the interest of justice and not outweighed by the public’s interest. If granted, the court sets aside the judgment and expunges the record. Afterward, the law treats the case as never filed. You can answer questions as if it never happened. The law takes effect six months after enactment.

No fee, fast eviction record removal

You do not pay a court filing fee to ask for an eviction expungement. When expungement is granted, within 45 days the court must give you a certified copy, tell you the records are no longer public, remove the case from public systems like CourtConnect, and store records so the public cannot access them. Courts can set rules and forms to run this process. The law takes effect six months after enactment.
