Clear opioid settlements and limits on suits

The law clarifies what counts as a statewide opioid settlement. It now includes consent judgments and consent decrees, filed or unfiled. Covered deals are between the State DOJ and opioid makers, distributors, pharmacies, consultants, related entities and individuals, and state subdivisions. They provide or allocate money for conduct tied to opioid products. Any Delaware government entity is barred from bringing released claims after February 28, 2021 against a party the Attorney General released in a statewide opioid settlement executed by the Attorney General and that party.
