Reverse auctions now allowed for professional services

Delaware can use reverse auctions for professional services when the state procurement office approves. Agencies may run an online auction to get pricing proposals. In these auctions, prices show live to all bidders but vendor names stay hidden. Vendors can cut their prices during the auction. Awards go to the lowest price or the most advantageous offer.

Agencies can use third-party auction platforms

The state or an agency can hire a third-party platform to run a reverse auction. Hiring needs written approval from the Section director or designee. They may do this without using the normal procurement process.

New preregistration and disclosure for reverse auctions

The state sets a simple process to run reverse auctions for professional services. Vendors must preregister before bidding so the state can vet responsibility. At registration, vendors agree to the solicitation’s contract terms and conditions. Each price proposal is recorded with the vendor’s name and address. Proposals stay private until a contract is signed, then become public unless the law exempts parts.
