State health data exchange established

The law creates the Delaware Health Information Network (DHIN) as a nonprofit public arm of the State. DHIN runs Delaware’s system for sharing health records and claims. Providers use it to send and receive patient data. This helps care teams see more complete records and coordinate care.

DHIN can charge service fees

DHIN can set reasonable fees for its services. Providers, insurers, employers, or other users may need to pay these charges. The law does not set the dollar amounts or dates; DHIN sets the fee schedule. The fees help fund the statewide health data exchange.

Tighter rules on sharing claims data

Claims data is shared only under DHIN’s security and privacy rules. All state and federal privacy laws apply. Providers, purchasers, and other recipients must protect any patient information they hold. When price or cost data is shared, DHIN and requesters follow federal antitrust guidance.
