Self‑insuring employers must report last year’s payroll by January 30 each year. The State charges a tax equal to 4% of the premium payable on that payroll, and payment is required to become or remain a self‑insurer. The Department can audit payroll and job classifications at the employer’s expense. Insurance carriers must also report compensation payments by March 31 and September 30 each year. The State calculates semiannual assessments that include 100% of workers’ comp administration, inspection, and safety costs. The State keeps a special Workers’ Compensation Fund, and any year‑end balance does not return to the General Fund.
Insurers and self‑insurers that break workers’ comp rules or make false statements are fined $100 to $1,000 for each offense after notice and a hearing. People who act for unauthorized insurers can be fined $100 to $1,000, jailed up to 90 days, or both. Fines are paid to the State.
When you and your employer agree on workers’ comp, they must file the signed agreement with the Department of Labor. After approval, it is final unless later changed under law. A Department form must explain eligibility, include your acknowledgment, and be notarized or witnessed. Disability checks or direct‑deposit forms must show a warning that accepting payment means you say you are entitled to it; false statements are crimes. Direct‑deposit forms must be dated and signed by you and the insurer. Deductible clauses do not need to be filed.
