New rules for minors' psychiatric admission and discharge

The law updates voluntary psychiatric admission and discharge for minors. If a youth is under 18 and in DSCYF custody under Chapter 25 of Title 13, the Division of Family Services Director, Deputy Director, or their designee can consent and sign the admission request. Parents or legal guardians can still consent. A voluntary patient, the parent or guardian, or—when the youth is in custody—the DFS Director, Deputy Director, or their designee can ask in writing at any time for discharge. The facility can require consent from those same parties before release. If discharge is requested against the treatment team’s and administrator’s advice, the facility can start involuntary treatment steps allowed under state law.
