Broader statewide membership and rules

The law sets who serves and who appoints them, including seats for residents or families, advocates, workers, and health professionals. Members must come from all three counties. Designees must be from the same organization and be named in writing. Most members serve three-year terms; missing 3 straight meetings or 4 of 12 counts as a resignation. Members elect a Chair, and a majority present is a quorum that can pass motions and bylaws.

Regular public meetings and annual report

The Commission meets at least four times a year. It can meet online but must have a public Delaware anchor location with a member or staff present. Each year it publishes a report with data on care and safety, visit findings, recommendations and letters with required redactions, policy positions, advocacy goals, and how the Executive Director spends time.

Staff hired, funding limits and reimbursements

The Commission hires an Executive Director and staff who work for the Administrative Office of the Courts. The Director may speak for the Commission. Hiring and support depend on yearly appropriations and any grants the Commission secures. Members are unpaid but can be repaid for reasonable, necessary expenses.

Stronger watchdog for long-term care residents

The law establishes a Commission to watch care, safety, and quality in long-term care facilities. It reviews complaints about abuse, neglect, mistreatment, and financial exploitation and tracks agency responses. It examines policies, monitors data and trends, visits facilities, and recommends fixes, laws, and rules. The Commission may form subcommittees to gather testimony and act. The Department of Justice provides legal advice.
