More older adults on aging council

The Council has at least 15 members, appointed by the Governor for up to 3 years, staggered so no more than 7 end in any year. More than half must be age 60 or older. Seats also cover adults with disabilities, caregivers, low‑income and minority groups, veterans’ issues, and two victim‑service agencies. A member may represent up to three areas. Members are unpaid but can be reimbursed for reasonable, necessary expenses. The chair serves 2 years and alternates between an aging and a disability representative; a chair may serve two non‑consecutive terms. A member who misses more than three straight meetings is removed unless the Council excuses the absences. Vacancies are filled only for the rest of the term.

Stronger council to guide aging services

The law strengthens the Council that advises Delaware’s aging and disability services. The Council can study, plan, and advise the Division, the Secretary, and the Governor. It can create subcommittees, and appointments to them must be approved by all Council members. A quorum is a majority of members, and policy and budget votes need a majority at a meeting with a quorum. The Division provides staff support to the Council and its subcommittees.

Tougher conflict rules for council

Members who represent service providers can serve only if they have no personal or financial interest and do not receive funding from the Division. The Division must adopt or change rules to prevent conflicts and follow federal Older Americans Act rules (45 CFR 1321.47 and 1321.63). These steps protect program integrity and help keep federal funding eligible.
