Prisons exempt from foam packaging ban

Level IV and Level V Department of Correction facilities are exempt from the statewide ban. They can keep using polystyrene foam food containers after July 1, 2025.

Restaurants must end foam food packaging

Beginning July 1, 2025, food establishments in Delaware cannot give ready-to-eat food in polystyrene foam containers. Restaurants, cafes, and takeout shops must switch to other packaging before that date.
