2026–2028 limit on power reliability charges

For 2026 through 2028, the Public Service Commission limits how much electric distribution companies can recover in rates for reliability capital. They cannot recover more than $125 million each year for these costs. The Commission may approve a higher amount only for emergencies or extraordinary needs.

Stops utilities from billing lobbying and ads

The law bars Delaware-regulated utilities from charging customers for lobbying or trying to sway laws or rules. Utilities also cannot recover dues to groups that lobby, political donations, or charitable giving, including to 501(c)(3) and 501(c)(4) groups. Most brand advertising and public relations that promote goodwill or influence public opinion cannot be put in rates. Ads required by law or a Commission order are allowed. Consumer education about income-based service, special rates, pilot programs, efficiency, beneficial electrification, renewable energy, and transportation electrification is allowed. Notices about outages, safety, emergencies, and job openings are also allowed. These rules apply to costs in base rates, riders, and other charges.
