Bill Overview

Analyzed Economic Effects

4 provisions identified: 3 benefits, 0 costs, 1 mixed.

Schools post registry info, no binders

The law ends the old paper binder rule for schools and child‑care providers. Schools and licensed child‑care providers must tell families and staff how to find the Registry online or in person and how to sign up for alerts, and include the website address. If they have a website, they must post this information there. If not, they must send it in writing at least once a year and provide it on request.

Online sex offender registry and alerts

Delaware centralizes public access on the State Police Sex Offender Central Registry website. You can sign up for alerts by area when someone is added, removed, or changes status. Records are searchable by name and location and update at least every three months. Public records show last verified addresses, convictions, conviction dates, and required registration details. They do not show victims’ names, Social Security numbers, or arrests without convictions; victim age appears only in ranges. Each record includes a warning not to use the information to harass or harm anyone.

Public notice for Tier II and III

When a Tier II or Tier III offender registers, police must give public notice. For Tier II, searchable public records are required and community notification may also be used. For Tier III, both searchable public records and community notification are required. If a Tier II or III offender plans to attend a school or study or work in a place, the school and the local chief law‑enforcement officer must be notified.

Legal protection for good faith notifications

Public officials and agencies are protected from civil lawsuits when they release sex offender information in their discretion. This protection does not apply if they act with gross negligence or in bad faith.
