When state testing finds PFAS above the legal limit, the Division alerts the water company. The water company must then mail every customer at the service address. The notice includes a PFAS brochure with the legal limits. It states that levels exceed the limit and lists the exact level for each PFAS over the limit.
Delaware sets legal PFAS limits for public drinking water. The limits are: PFOA 4.0 ppt and PFOS 4.0 ppt. PFHxS 10 ppt, PFNA 10 ppt, and GenX (HFPO-DA) 10 ppt. For mixtures of two or more of PFHxS, PFNA, HFPO-DA, or PFBS, a hazard index of 1 is the limit. The law covers PFAS with at least one -CF3 or -CF2- group and only those with set legal limits.
The state runs a public website with PFAS test results for every public water system. You can reach it from the Office of Drinking Water home page. The site shows the legal limits. If results are not ready, it shows when they will be posted and adds them when available.
Delaware’s health department must carry out and enforce the PFAS rules for public water. The Division of Public Health can write regulations to set testing, reporting, and enforcement steps. The law takes effect 90 days after enactment.
